1. Acceptance of Terms

By accessing or using the GoCaboodle platform, website, mobile app, browser app or related services (collectively, the “Service”), you agree to be bound by these Terms and our Privacy Policy (collectively, the “Agreement”). If you do not agree, do not use the Service.

2. Eligibility

Account creators represent and warrant that they are at least 18 years of age and will use the platform for it’s intended purpose, to curate high quality content for junior accounts of children in their care.

Account creators understand and agree that GoCaboodle cannot and will not review, remove, rate or curate content that may be considered objectionable. It is the responsibility of the community to use their judgement in reviewing content that they curate or select for their junior accounts (children in their care).

You will not use the service for anything other than its intended purpose. You will not copy the organizational model, UI, lists of curated content and you will not use any of the content available or organization of it thereof as a training model for LLMs, Apps, Software or any other purpose.

If you access the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. User-Generated Content & Moderation

Responsibility for Content: You acknowledge and agree that all videos, comments, annotations, links, and other content (“User Content”) that you access, organize, or display through the Service originate from third-party sources (e.g. YouTube). You are solely responsible for moderating all User Content you surface.

No Control, No Warranty: GoCaboodle.com does not control, endorse, or verify the accuracy, completeness, or legality of any User Content. The Service provides tools so you can filter, tag, or organize content—but you assume all risks associated with that content.

Youth Exposure: You assume full responsibility for supervising and ensuring age-appropriate access for Junior Accounts that you control and the Children/Minors that use the Service under your Junior Accounts or view content you’ve organized, GoCaboodle.com expressly disclaims all liability for any harm or exposure to inappropriate content.

4. Intellectual Property

Our Rights: The Service, including all design elements, user interface (UI), functionality, architecture, workflows, code, graphics, logos, and trademarks, is the confidential, proprietary property of GoCaboodle.com or its licensors.

Your License: We grant you a limited, non-exclusive, non-transferable license to access and use the Service solely for your internal personal use, subject to these Terms.

Prohibited Uses: You may not (and may not permit others to):

1. Copy, reproduce, distribute, or create derivative works of any part of the Service—including UI, design, or functionality—without our express prior written permission.
2. Reverse-engineer, decompile, disassemble, or otherwise attempt to discover any source code or underlying ideas.
3. Use the Service, or any data, output, or structure thereof, to train, develop, or improve any machine‑learning, artificial‑intelligence, or similar models, without our express prior written permission.

5. Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately atsupport@gocaboodle.com of any unauthorized use or breach of security.

6. Fees and Payment

If you subscribe to a paid plan, you agree to our Subscription Terms and authorize recurring charges to your chosen payment method. All fees are non‑refundable except as expressly provided. We reserve the right to institute a paid model at any point in time.

7. Termination

• By You: You may stop using the Service at any time.
• By Us: We may suspend or terminate your access immediately if you violate these Terms or for any other reason, with or without notice.
• Effect: Upon termination, all licenses granted to you end and you must cease all use of the Service.

8. Disclaimers & Limitation of Liability

• AS‑IS Service: The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind. We expressly disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non‑infringement.
• No Liability for User Content: We assume no liability for User Content or its moderation.
• Limitation: To the maximum extent permitted by law, our total liability to you for any claim arising from or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim.
